Terms of Service
These terms govern your access to and use of Caseo (caseo.co.za), a software-as-a-service legal practice management platform operated by Synara AI (Pty) Ltd (registration number 2025/921363/07), a company registered in the Republic of South Africa trading as Caseo (the "Service", "we", "us", "our"). By accessing the Service, joining the waitlist, or creating an account, you agree to these terms.
1. Eligibility
You must be at least 18 years old, legally capable of entering into a binding contract, and (where you are using Caseo on behalf of a law firm or other organisation) authorised to bind that organisation.
2. Your account and security
You are responsible for keeping your sign-in credentials confidential and for all activity that occurs under your account. Notify us immediately at hello@caseo.co.za if you suspect unauthorised access. Each member of your firm needs their own account — credentials may not be shared.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in breach of any applicable South African law (including the Legal Practice Act, the Financial Intelligence Centre Act, and the Protection of Personal Information Act);
- Attempt to access, probe, reverse-engineer, decompile or disrupt the Service or any underlying infrastructure;
- Upload or transmit any content that infringes third-party rights, contains malicious code, or breaches a confidentiality or attorney–client obligation you owe to another party;
- Resell, sublicense, or otherwise commercialise access to the Service without our prior written consent.
4. Your data
Matter records, client information, transactions, documents and any other content you or your firm submit to the Service ("Firm Data") belong to you. You grant us a limited licence to host, process, transmit and display Firm Data solely to operate the Service and to provide support and security. We do not sell Firm Data, and we do not use it to train third-party models.
On request, and on termination, we will export your Firm Data to you within 30 days. After termination we return or delete Firm Data from our active systems within 30 days, except records the law requires to be kept (LPC and FICA records, five years), which we hand over to you. Encrypted backups may persist for a further 30 days before being overwritten.
5. Privacy and POPIA
Our handling of personal information — yours, your colleagues', and your clients' — is described in our Privacy Policy and our Trust & compliance page. We act as an operator (POPIA) for personal information your firm submits about its clients, and as a responsible party for personal information you give us directly (e.g. account details, billing).
6. Fees
The Service costs R1,000 per month per firm, billed monthly in advance in ZAR. There is no setup fee. The subscription runs month to month, and either of us may cancel it on 30 days' written notice (see section 11). We will give you 30 days' written notice before any change to recurring fees.
7. Service availability
We aim for high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We are not liable for outages caused by third-party infrastructure (e.g. cloud providers, payment networks, courts' e-filing systems) outside our reasonable control.
8. Confidentiality
We treat all Firm Data as confidential, and only Caseo personnel who need access for support, security or operations will see it. We will not disclose Firm Data to any third party except (a) with your instruction, (b) where compelled by law or a court order, or (c) to sub-processors bound by equivalent confidentiality terms (see the Privacy Policy for the current list).
9. Intellectual property
Caseo, the Caseo wordmark, the aperture mark and all software, designs and documentation forming part of the Service remain the property of Synara AI (Pty) Ltd. You receive a non-exclusive, non-transferable right to use the Service for your firm's internal legal practice. No other rights are granted.
10. Limitation of liability
To the maximum extent permitted by South African law, our aggregate liability under or in connection with these terms — whether in contract, delict or otherwise — is capped at the fees you paid to us in the 12 months immediately preceding the event giving rise to the claim. We are not liable for indirect, consequential or special-damages losses (including lost profits, lost opportunity, or damage to reputation), even if foreseeable.
Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded — including liability for fraud, wilful default, or death or personal injury caused by negligence.
11. Termination
Either of us may terminate the agreement on 30 days' written notice (or immediately for material breach that is not cured within 14 days of written notice). We may also suspend access immediately if your use of the Service threatens its security, integrity, or other customers — we'll tell you why as soon as practicable.
12. Governing law and jurisdiction
These terms are governed by the laws of the Republic of South Africa. Any dispute is subject to the exclusive jurisdiction of the South African courts, and the parties consent to the jurisdiction of the High Court of South Africa, Gauteng Division (Pretoria) for proceedings of competent value.
13. Changes to these terms
We may update these terms from time to time. If a change is material, we will email all account holders and the in-app notice will run for at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
